Apple Ordered To Pay $302 Million in Damages to VirnetX For Patent Infringement

A jury has ordered Apple to pay $302.4 million to VirnetX Holding Corp over using its patented virtual private networking protocols in FaceTime and iMessage on the iPhone, iPad and Mac. The case will now go to the United States Court of Appeals for the Federal Circuit in Washington DC before VirnetX sees any payout, Reuters and Bloomberg reported today.

It is yet to be determined if Apple willingly infringed VirnetX’s patent in which case the damage amount can be even higher. A separate trial will take place for the same.

The federal jury in Texas who passed the order had previously thrown out VirnetX’s $625.6 million win over Apple from a previous trial stating that the jurors might have been confused in the case.

The $302 million damage amount is related to two patents that have been confirmed to be infringed by Apple. It is still to be determined if Apple infringed on the other two patents of VirnetX as well along with the relevant damages.

VirnetX filed its first legal case against Apple back in 2010.
